BestBox Fitness Inc. (“BestBox”, “we” or “us”) respects your privacy and is committed to maintaining the accuracy, confidentiality and security of your Personal Information. This Privacy Policy describes what Personal Information we collect when you use our website, mobile applications, software and other services (“Services”), and how we use, protect and disclose this information.

It is our policy to comply with the privacy legislation within each jurisdiction in which we operate. For instance, BestBox is governed by the Personal Information Protection Act of British Columbia (“PIPA”), which sets out rules for how organizations collect, use and disclose Personal Information. Under PIPA, Bestbox may only collect, use, or disclose Personal Information that is necessary to fulfil the purpose of the collection.

Sometimes the privacy legislation and/or an individual's right to privacy are different from one jurisdiction to another. This Privacy Policy covers only those activities that are subject to the provisions of Canada's federal and provincial privacy laws, as applicable.

This Privacy Policy has a limited scope and application. Consequently, the rights and obligations contained in this Privacy Policy may not be available to all individuals or in all jurisdictions. What Personal Information Do We Collect?

For the purposes of this Privacy Policy, Personal Information includes information that is reasonably capable of identifying a particular individual either alone or when combined with information from other available sources, other than business contact information or work product information (“Personal Information”).

The Personal Information we collect will depend on how you choose to interact with us and use our services. For example, BestBox gathers Personal Information when you sign up for a user account, use forums, chat areas, calendars or other means of communication and sharing of information through use of our Services.

When you sign up or pay for the Services of a BestBox vendor, we collect information that you provide to us or input into our applications, including your full name, username, company name, email address, mailing address, phone number, profile photograph, age, weight, height, birth date, job title, places you work out, information about your fitness routines, and scores for your workouts. We may also collect information about how you use our Services to improve or enhance the Services we provide on behalf of BestBox vendors, gyms and clients.

BestBox does not collect or store your credit card information – this information is processed through third party providers, including Stripe. We encourage you to review their privacy policies and guidelines as well.

If you decide to use our Services, you may choose to give BestBox access to information from your device, including information about your geographic location, contacts, the type of device you use and information about your mobile software.

BestBox also collects aggregate data, which is information that does not identify a specific individual in and of itself. This information is collected and compiled and analyzed from the Personal Information as well as other data collected through the use of our Services.

Why Do We Collect, Personal Information, and How Do We Use It?

The Personal Information we collect may be used by BestBox for the purposes for which it was collected, as provided in this Privacy Policy, or for other purposes that are disclosed to you and to which you consent.

For example, we collect and use your Personal Information to:

create accounts, communicate membership info to gyms using our platform, provide workout history & background to gyms, process transactions, respond to your inquiries and provide technical support, supply you with requested products or Services, send you informational or promotional communications, improve our Services, carry out other purposes that are disclosed to you and to which you consent, and carry out any other purpose permitted or required by law.

How Do We Share Your Personal Information?

We may transfer Personal Information to trusted third party service providers that assist us with carrying out the purposes noted above. For example, we may rely on service providers to provide products and services, process credit card payments, provide customer service, and host our Services and data. In such cases, BestBox will confirm that any third party with whom we share Personal Information will provide the same or substantially equivalent protection of Personal Information as stated in this Privacy Policy.

Your Personal Information may also be shared with our employees, contractors, consultants, affiliates and other parties who require such information to assist us with establishing, maintaining and managing our relationship with you.

In addition, Personal Information may be disclosed or transferred to another party in the event of a change in ownership of, or a grant of a security interest in, all or a part of BestBox.

We may also disclose Personal Information to others when permitted or required by law (for example, a court order, subpoena or search warrant).

How do we collect information?

You may wish to provide, and we may collect, Personal Information that you submit to us through our website and applications, such as your name, email address, billing address, and any other information that you choose to provide in using our Services.

You may also choose to use our Services to share your Personal Information with other users, such as your height, weight, birth date, profile picture, and workout information.

BestBox may use "cookies" and other similar devices to enhance our Services. For example, cookies may track information which includes: (i) IP address; (ii) the type of web browser and operating system used; and (iii) the pages of our website you visit. If you wish to disable cookies, refer to your browser help menu to learn how. If you disable cookies, you may be unable to access some features on our site.

If you request information from us, we may use the email address that you provide to send you information about offers on products and services that we believe may be of interest to you. If you have asked us to put you on an email mailing list to provide you with certain information on a regular basis, or if we send you information about our offers on products and services by email, you may ask us to remove you from the list at any time (using the unsubscribe instructions provided with each email and on the site where you signed up).

Our Services may contain links to other websites that may be subject to less stringent privacy standards. We cannot assume any responsibility for the privacy practices, policies or actions of the third parties that operate these websites. BestBox is not responsible for how such third parties collect, use or disclose your Personal Information. You should review the privacy policies of these websites before providing them with Personal Information.

How Is Your Personal Information Protected?

BestBox maintains physical, technical and procedural safeguards that are appropriate to the sensitivity of the Personal Information in question. These safeguards are designed to prevent your Personal Information from loss and unauthorized access, copying, use, modification or disclosure.

For example, BestBox uses security features like two-factor authentication, restricting access to Personal Information to our senior officers and those who need-to-know, and providing alerts when new devices access your account. We also require you to create and enter a password to access any accounts you may have with us.

Some or all of the Personal Information we collect may be stored or processed in jurisdictions outside of Canada, including the United States. As a result, this information may be subject to access requests from governments, courts, or law enforcement in those jurisdictions according to laws in those jurisdictions.

Unfortunately, no data transmission over the internet can be guaranteed to be 100% secure. As a result, while BestBox strives to protect your Personal Information, we cannot warrant the security of any information you transmit to us, and you do so at your own risk. Once we receive your Personal Information, we make commercially reasonable efforts to ensure its security on our systems.

Your Consent Is Important to Us

BestBox will obtain your consent to collect, use, or disclose your Personal Information, except where we are legally authorized or required by law to do so without your consent. We may obtain your consent orally, in writing or electronically, and your consent may be implied or express, depending on the nature and sensitivity of the Personal Information. Your consent will not be required beyond what is necessary to provide you our products and Services.

BestBox will not collect, use, or disclose Personal Information except for the purposes identified in this policy, unless we have received additional consent or the processing is authorized without consent.

By using our Services, we assume that you have consented to the collection, use and disclosure of the information you have submitted. You may change or withdraw your consent at any time, subject to legal or contractual restrictions and reasonable notice, by contacting our Privacy Officer at [email protected].

In some circumstances, a change in or withdrawal of consent may severely limit our ability to provide products or Services to, or acquire products or services from, you. All communications with respect to such withdrawal or variation of consent should be in writing and addressed to our Privacy Officer.

Updating and Deleting Personal Information

It is important that the information collected and contained in our records is complete, accurate and current. If your Personal Information changes during the course of our relationship, please keep us informed of such changes.

You can update, change and delete your Personal Information by logging into your BestBox account and editing your profile information, or by sending your request in writing to our Privacy Officer at [email protected]. If you wish to delete your account, please write to us at the same address and we will do our best to fulfill your request, subject to our legal and business obligations.

BestBox strives to fulfill reasonable information update requests, and will send notice of your information update to any organizations your Personal Information was disclosed to during the year prior to the date the correction was made. If BestBox considers the request to not be reasonable, we will annotate the information, noting that the correction that was requested was not made.

Retention of Personal Information

We only keep your Personal Information as required to fulfill our legal obligations, or in order to provide our Services to our users. If Personal Information is no longer in use it will be deleted or anonymized (unless doing so is contrary to our legal requirements, or frustrates our performance of a legal obligation, such as a contract).

In addition, we retain Personal Information used to make decisions that directly affect individuals for at least one year after that decision has been made. After that time has passed, we will delete or anonymize Personal Information once it is no longer necessary to fulfil the identified purposes or any other legal or business purpose.

Access to Personal Information

You have the right to access your Personal Information, information about the ways in which your Personal Information is or has been used, and the names of the individuals and organizations to which your Personal Information has been disclosed.

If you want to review, verify or correct your Personal Information, please contact our Privacy Officer in writing at [email protected]. BestBox reserves the right to require proof of identity before giving you access to your Personal Information, and to charge a nominal fee, as considered necessary. We aim to meet all requests within 30 business days of the original request.

In the event that we cannot provide you with access to your Personal Information, we will inform you of the reasons why, subject to any legal or regulatory restrictions.

If you have questions or concerns over how your Personal Information is being handled, please contact our Privacy Officer in writing, or contact the Office of the Information and Privacy Commissioner for British Columbia or the Office of the Privacy Commissioner of Canada.

Minors

Our Services are intended for customers who are 16 years of age and older. We do not knowingly collect, use or disclose Personal Information from minors under the age of 16.

Revisions to this Privacy Policy

BestBox Fitness Inc. from time to time, may make changes to this Privacy Policy to reflect changes in its legal or regulatory obligations or in the manner in which we deal with your Personal Information. We will post any revised version of this Privacy Policy on our website www.bestbox.co and we encourage you to refer back to it on a regular basis.

Interpretation of this Privacy Policy

Any interpretation associated with this Privacy Policy will be made by our Privacy Officer. This Privacy Policy includes examples but is not intended to be restricted in its application to such examples; therefore where the word "including" is used, it means "including without limitation".

This Privacy Policy does not create or confer upon any individual any rights, or impose upon BestBox any obligations outside of, or in addition to, any rights or obligations imposed by Canada's federal and provincial privacy laws, as applicable. Should there be, in a specific case, any inconsistency between this Privacy Policy and Canada's federal and provincial privacy laws, as applicable, this Privacy Policy shall be interpreted, in respect of that case, to give effect to, and comply with, such privacy laws.
